Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Benefit-Assist mobile application and related services (collectively, the "Service") provided by Benefit-Assist, LLC ("Benefit-Assist," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.


1. Eligibility

The Service is intended for use by adults (18 years of age or older) who are employees, HR personnel, or benefits administrators authorized by a participating employer, or by benefits brokers who have entered into a separate agreement with Benefit-Assist. By using the Service, you represent that you meet these eligibility requirements.


2. Description of the Service

Benefit-Assist provides an AI-powered assistant ("Ben") that answers employee questions about their employer-sponsored benefits based on plan documents uploaded by the employer. The Service is available via mobile application on iOS and Android and supports both text and voice input in English and Spanish.

The Service is informational only. Ben's responses are based on plan document content and are not medical, legal, or financial advice. You should consult qualified professionals for advice specific to your situation. Always refer to your official plan documents and contact your plan administrator or insurer for authoritative information about your coverage.


3. Account Registration and Access

Access to the Service may be granted through your employer or directly through the app. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@benefit-assist.com if you suspect unauthorized access to your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:


5. Intellectual Property

All content, software, and technology comprising the Service - including Ben, the underlying AI system, and the Benefit-Assist name and branding - are the property of Benefit-Assist, LLC or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.


6. Employer-Uploaded Content

Plan documents and related materials uploaded by employers remain the property of the employer or the relevant plan documents' rights holders. By uploading content to the Service, the employer grants Benefit-Assist a limited license to use that content solely to operate and improve the Service for that employer's account.


7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE. BEN'S RESPONSES ARE BASED ON UPLOADED DOCUMENTS AND AI PROCESSING AND MAY NOT REFLECT THE MOST CURRENT PLAN INFORMATION.


8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BENEFIT-ASSIST, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.


9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or for any other lawful reason. Upon termination, your right to use the Service ceases immediately.


10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.


11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date and providing notice through the app or by email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
